Central Asset Finance Ltd of Westway House, Sidcot Lane, Winscombe BS25 1LA ("CAF ") observes the highest standards of practice in all its activities and treats all the personal information it collects in strict compliance with the The General Data Protection Regulation (GDPR) which will apply from 25 May 2018, when it supersedes the UK Data Protection Act 1998 (DPA).

For the purpose of the GDPR, the data controller is CAF. Our nominated representative for the purpose of the Act is Julie Brooks.

CAF are committed to attaining the best standards of practice and treat all your personal information as private and confidential. Therefore, we have implemented appropriate procedures to protect your privacy and confidentiality so that none of your personal information will be disclosed to anyone than in exceptional circumstances, as permitted by law or as set out below.

This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

Information we may collect from you:

We will collect and process the following data about you:
• Information you give us.
• by corresponding with us by phone, e-mail or otherwise.
• the information you give us may include your name, address, e-mail address and phone number, and financial information.

Personal information will not be kept longer than is reasonably necessary.

Uses made of the information

We use information held about you in the following ways:
• To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes.
• To notify you about changes to our service and to carry out our obligations arising from any contracts entered into between you and us.

If you are a new customer, and where we permit selected third parties to use your data, we (or they) will contact you by electronic means only if you have consented to this. If you do not want us to use your data in this way, or to pass your details on to third parties for marketing purposes, please tick the relevant box situated on the contract on which we collect your data. You can also exercise the right at any time by contacting our Customer Services (details below).

Information we receive from other sources.

We will combine this information with information you give to us and information we collect about you. We will use this information and the combined information for the purposes set out above (depending on the types of information we receive).

Disclosure of your information

You agree that we may:-
• disclose information to third parties, including manufacturers, resellers, suppliers, funders, insurers, so that they can use it to market their products and services
• disclose information to credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you
• disclose information where required or permitted to do so by law, or to government entities or regulatory bodies in order that they may discharge their responsibilities and obligations or to exercise their powers or functions
• disclose information if CAF or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
• disclose information if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions, or the terms and conditions of any agreement we have with you; or to protect the rights, property, or safety of CAF, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
• market our products and services or selected third parties.
• transfer information to any country, including a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or a third party. Such staff may be engaged in, among other things, the processing of your payment details and the provision of support services.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy. If no satisfactory data protection laws exist in the country to which we are transferring your personal data, we will put in place equivalent contractual safeguards to those contained in the Act.

Where We Store Your Personal Data

All information you provide to us is stored on our secure servers.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes situated on the contract between us we use to collect your data. You can also exercise the right at any time by contacting us (details below).

Access To Information

The GDPR gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request about the information we hold about you can be exercised at any time by contacting CAF on the address above.

If you think any details CAF hold about you are incorrect (for example out of date address), please write to us (details below). Any information which is incomplete/incorrect/out of date etc. shall be amended as soon as reasonably possible.

Use of personal information

In considering your application, we or our funders to whom we may use for our agreements may search your credit record.
We will perform credit and identity checks on you with one or more credit reference agencies (CRAs). We may also make periodic searches at CRAs to manage your account with us.

To do this, we will supply your personal information to CRAs and they will give us information about you. This will include information from your credit application and about your financial situation and financial history. CRAs will supply to us both public (including the electoral register)
And shared credit, financial situation and financial history information and fraud prevention information.

We will use this information to:

  • Assess your creditworthiness and whether you, your financial associate(s), or your business can afford to take the product;
  • Verify the accuracy of the data you have provided to us;
  • Prevent criminal activity, fraud and money laundering;
  • Manage your account(s);
  • Trace and recover debts; and
  • Ensure any offers provided to you are appropriate to your circumstances.

We will continue to exchange information about you with CRAs while you have a relationship with
Us. We will also inform the CRAs about your settled accounts. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs.

When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders.

If you are making a joint application, or tell us that you have a financial associate or business partner, we will link your records together, so you should make sure you discuss this with them, and share with them this information, before lodging the application. CRAs will also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for disassociation with the CRAs to break that link.

We may undertake searches for the purposes of verifying your identity and for anti-money laundering purposes. To do so CRAs may check the details you supply against any particulars on any database (public or otherwise) to which they have access. They may also use your details in the future to assist other companies for verification purposes. A record of the search will be retained. If you are a joint applicant, such as a partnership, unincorporated association or if you are a body corporate, such as a limited company or LLP or charity, you confirm to us that you have obtained the relevant consent to authorise us to create an identity search against any partner/ trustee /officer/ director/shareholder (as so required) at the CRAs.

We may share or store your information with our funders and any person to whom we intend to pass the Agreement to, and they may use your information or make further searches as they may require, in the same manner as set out above. Fraud prevention agency records will also be shared with other organisations to help make decisions on motor, household, credit, life and other insurance proposals and insurance claims, for you and members of your household.

Information about all applicants will be collected and held on CAF's systems and database and will be used to process your application and for ongoing account maintenance and administrative purposes. It will be held in accordance with the GDPR and we will only disclose it to other companies such as our lawyers, auditors, external advisors, agents and third parties as well as anyone to whom we transfer our rights and duties under your agreement with us, together with their lawyers, auditors and external advisors, agents and rating agencies.
We will also disclose your personal information to third party service providers who we engage from time to time but we will always endeavour to ensure that they hold it in accordance with the GDPR.

Call Recording

Should you ring us your calls may be recorded to help us improve our service, to assist us in training, to evidence communication between us and in the interests of security. We also record some of the outgoing calls that we make for the above reasons. You may voluntarily give personal data to enable you to request information from us or provide feedback.
